Abstract

Parental authority is part of the content of Family Law, this is pertinent to define it from the perspective of its legal effects, whether it produces new family conformations, better known as family types, and its incidence and influence on the integral development of children and adolescents, under a view of their best interests. This document is based on the classic definition of parental authority, to continue with the legislative expansion of its content and the analysis of related jurisprudence of theConstitutional Court of Ecuador, to determine whether the granting or deprivation of parental authority gives rise to other types of families that go beyond the concept of nuclear family. The aim is to understand the need for legislative advances on parental authority and its impact on the constitutional recognition of new types of families considering the judicial process of parental authority in 2022.
