Abstract

In the last decade, the recognition of the rights of Nature has emerged as a revolutionary approach in the legal field, offering the opportunity to reconfigure our perceptions and structures social, political and legal. This innovative paradigm highlights the emancipatory potential of these rights, which challenge anthropocentrism and advocate for the protection of all forms of life from a counterhegemonic perspective. However, it is crucial to carefully evaluate regulatory reforms to avoid negative impacts on the human rights, ensuring their effective application. Ecuador, in 2008, became the world pioneer by granting rightsconstitutional to Nature. This legal innovation is not limited to a simple enunciation of rights, but rather establishes a complex legal universe with principles, rights and guarantees for the protection of Nature. This text focuses on analyzing the development of the constitutional norms relating to the rights of Nature through of the jurisprudence of the Ecuadorian Constitutional Court, specifically to the milestone sentence of the “Mona Estrellita”.
