Cognitive Biases in Constitutional Justice from the Psychology of Judgment and Decision-Making

This project analyzes the interaction between constitutionalism, cognition, and social rights in Ecuador, focusing on cognitive biases among ordinary judges and the Constitutional Court, as well as the expansive use of normative powers by the Executive between 2019 and 2025. The research is based on the premise that both decision-making errors and the concentration of power affect the guarantee of rights and democratic quality. The methodology employs a mixed-methods approach, combining document review of jurisprudence and normative acts with natural language processing (NLP) techniques to identify error patterns and biases. It aims to systematize the dispersion of judicial criteria and the impact of presidential powers on the balance of functions. Expected results include a typology of presidential normative exercise and the identification of recurrent biases in the judiciary. The project seeks to propose training and corrective measures that strengthen legal certainty, equality, and the effectiveness of protection mechanisms, contributing to scientific production through indexed articles and book chapters.<br/><br/><b>Goal</b>: <br/>To examine in an integrated manner the impact of cognitive errors in constitutional justice and the exercise of the President's co-legislative powers during the 2019–2025 period.
