Research Interests
The research focuses on the structural and practical challenges of constitutionalism, specifically within the Ecuadorian legal framework. A central objective is to bridge the gap between abstract doctrinal theory and the effective enforcement of rights through a disciplined, transparent, and pluralistic methodology. The work emphasizes that the efficacy of a constitutional state relies on the coherence between legal dogma, the organization of institutional power, and rigorous jurisdictional praxis. By demystifying the notion of neutral interpretation, the research proposes a structured architecture of interpretive guidelines—ranging from linguistic to functional and procedural criteria—to ensure that judicial decisions are verifiable, rights-oriented, and free from decisionism. Furthermore, the research explores the evolution of the biocentric paradigm, analyzing how the constitutional recognition of the Rights of Nature challenges traditional anthropocentric legal structures. Through an extensive examination of constitutional jurisprudence, the work evaluates the transition toward recognizing animals as subjects of rights and the necessity of balancing these innovative protections with existing human rights frameworks. Ultimately, the research provides a pedagogical and practical toolkit for legal practitioners, advocating for a systematic approach to constitutional guarantees, the control of constitutionality, and the institutional design required to transform constitutional promises into enforceable realities.
